TestYourSkills ("we", "us", "our") is operated by a sole trader registered in Spain. We operate the website testyourskills.app. For privacy enquiries: acreatorstore@translatea.com.

As a business registered in Spain serving EU customers, we comply with the General Data Protection Regulation (GDPR) and applicable Spanish data protection law.

2. Data We Collect

Account data: Your email address, number of assessments used, and subscription status. We do not store payment card details — these are handled entirely by Stripe.

Submitted content: Files, text, or audio you upload for assessment are processed temporarily to generate your result. They are not stored after the assessment is complete.

Assessment results: Your scores and skill levels are stored against your email to track your usage credits and history.

Technical data: Standard server logs including IP address, browser type, and access timestamps, used for security and diagnostics only.

3. How We Use Your Data

To deliver assessments and track your credit balance
To process payments and manage subscriptions via Stripe
To send transactional emails (receipts, account notices)
To prevent abuse and enforce usage limits
To respond to support requests
To comply with legal obligations

We do not use your data for advertising, profiling, or any purpose beyond operating the Service.

4. Legal Basis for Processing (GDPR)

Contract performance — processing your email and usage data to deliver the Service
Legal obligation — retaining billing records as required by Spanish tax law
Legitimate interests — server logs for security and abuse prevention

5. Data Sharing

We share data only with the following processors, each bound by appropriate data protection agreements:

Stripe — payment processing (stripe.com/privacy)
Render — application and database hosting (render.com/privacy)
xAI (Grok) — AI skill assessments (x.ai/privacy)
OpenAI (Whisper) — audio transcription for speaking assessments (openai.com/privacy)

We do not sell your personal data.

6. Data Retention

Account data is retained while your account is active plus 12 months after your last use. Billing records are retained for 7 years as required by Spanish tax law. Submitted files and audio are not stored after processing. Server logs are retained for up to 90 days.

8. Cookies

We use only essential cookies required for the Service to function (session state, authentication). No tracking, advertising, or analytics cookies are used.

9. Data Transfers

Some processors operate outside the EU (Stripe, Render, xAI, OpenAI). Where this occurs, transfers are made under Standard Contractual Clauses approved by the European Commission.

10. Security

We use HTTPS encryption, access controls, and regular security reviews to protect your data. No internet transmission is 100% secure.

11. Children

The Service is intended for users aged 16 and over. We do not knowingly collect data from anyone under 16.

12. Changes

We may update this policy at any time. Subscribers will be notified of material changes by email. Continued use after changes constitutes acceptance.
